What you get, and what we owe you

These are the terms for buying and using Ferric instruments, made by Ferric Instrument Works ("we", "the shop"), San Diego, California. Buying or using an instrument means you accept them.

What you are buying

A licence to use the instrument, for as long as you like, on the devices you own. You buy a machine, it is yours, and it keeps working. Specifically:

• One-time purchase. Never a subscription for an instrument. There is no renewal and nothing expires.
• No account required to play. Sign-in is never a gate between you and sound.
• Works offline, permanently. No server check, no licence validation.
• Revisions are free. Rev. B is not a new purchase.
• Add-ons stay bought. Every pedal or pack is a non-consumable that stays on your shelf. Restore purchases always works.
• Your work is yours. Recordings, presets and exports belong to you, in open formats, with no claim from us. Sell the records you make. We want nothing.

What you may not do

Redistribute, resell, or repackage the software itself; reverse-engineer it except where the law says you may; or strip the marks and pass it off as something else. Making and selling music with it is entirely yours — that is the whole point.

Where you buy matters

On the App Store, Apple is the seller. Apple's terms and refund policy govern that purchase. Refunds are requested through Apple (reportaproblem.apple.com), not through us — we cannot issue them, though we will always help you sort out a problem.

Buying THE FERRIC RACK direct goes through our payments partner, who acts as merchant of record and appears on your statement. Their checkout terms apply alongside these. If the Rack does not work on your machine, write to us within 30 days and we will refund it. A tool that does not run on your desk is not a tool.

Beta builds

Beta testing is free and runs through Apple's TestFlight. Beta software is unfinished by definition — it may misbehave, and builds expire. Do not trust a beta with the only copy of something you care about. Taking part does not obligate you to buy anything, and it does not obligate us to ship any particular feature.

What we can't promise

We build these carefully and we use them ourselves for real work. But software is software: it is provided "as is", without warranty of any kind, express or implied, including fitness for a particular purpose. We do not warrant that it will be uninterrupted or error-free.

To the extent the law allows, our total liability for any claim relating to an instrument is limited to what you paid for it. We are not liable for lost recordings, lost profits, or other indirect or consequential damages. Some places do not allow these limits, in which case they apply to you only as far as the law permits — and your statutory consumer rights are untouched by anything on this page.

Keep backups. That is true of every studio that has ever existed.

Prices and availability

Prices are in US dollars and may change; the price you paid is the price you paid, and a change never reaches back. Local taxes may be added at checkout. We may retire or change an instrument over time, but anything you have already bought stays yours and keeps working.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules.
